Refund Policy

Overview

This Refund Policy ("Refund Policy") governs all payments made to DialClear LLC, a New Mexico limited liability company ("DialClear," "we," or "us") for any lookup, usage-based charge, or other Service offered on or through the DialClear platform at dialclear.co (the "Platform"). This Refund Policy is incorporated by reference into and forms part of the DialClear Terms of Service. By using any Service, you acknowledge that you have read, understood, and agreed to this Refund Policy in addition to the Terms of Service.

In the event of any conflict between this Refund Policy and the Terms of Service, the Terms of Service shall control. Capitalized terms not defined herein have the meanings given to them in the Terms of Service.

How Billing Works

DialClear has no monthly subscription fee. You are charged per lookup — phone scrubs, address verifications, geolocation lookups, and any other metered Service — at the per-lookup rates published on the Platform, with volume-tier discounts applied automatically. Usage is metered through our payment processor and billed daily in arrears for the previous day's completed lookups, to the payment method on file.

Because pricing is metered, there are no prepaid subscription terms, no unused subscription time, and no proration. Each daily invoice reflects only lookups you actually ran the previous day.

Completed Lookups Are Non-Refundable

Each completed lookup consumes third-party data services — DNC registry checks, litigator database queries, carrier and validity data, address verification, and geolocation data — the moment it runs, and DialClear incurs those costs immediately and irreversibly. For that reason, charges for successfully completed lookups are final and non-refundable, including but not limited to charges arising from:

  • Lookups run against numbers or addresses you later decide you did not need to scrub.
  • Lookups run by mistake, in duplicate by you, or against incorrect or low-quality input data you supplied.
  • Lookups triggered automatically by an integration (including LeadConnector) or API workflow you configured.
  • Dissatisfaction with a lookup result, including results indicating a number is clean, on a DNC registry, or associated with a known litigator.
  • Non-use or underuse of the Platform, change of mind, change of business direction, or business closure.
  • Termination or suspension of your account for breach of the Terms of Service.

You are responsible for evaluating the Platform and its suitability for your needs before running lookups at volume. DialClear requires no card to sign up and no monthly minimum, so you can review documentation and pricing before adding a payment method and incurring any charges.

Any refund, credit, or exception, if ever granted, is made solely at DialClear's discretion, applies only to the specific instance for which it is granted, and does not constitute a waiver of this Refund Policy or a precedent for any other refund.

Billing Errors and Failed Lookups

Notwithstanding the foregoing, DialClear will refund or credit, upon request and after verification:

  • Charges resulting from a billing or metering error on DialClear's side, including charges for lookups you did not run.
  • Duplicate charges for the same lookup caused by a DialClear system error.
  • Charges for lookups that failed to complete due to a DialClear service error. Lookups that complete but return a result you did not expect are not failed lookups.

To request a refund or credit, contact us at the address in the Contact section below within thirty (30) days of the charge appearing on your statement, with the affected invoice date(s) and, where possible, the lookup(s) in question from your lookup history. Verified amounts will be refunded to your original payment method or credited against future usage, at your preference where feasible.

Disputes and Chargebacks

If you believe you have been billed in error or have a billing concern, you agree to contact DialClear first to attempt to resolve the matter in good faith before initiating any chargeback, payment reversal, or payment dispute with your credit card issuer, debit card issuer, bank, payment processor, or any other financial institution. Initiating a chargeback or payment dispute without first contacting DialClear constitutes a material breach of this Refund Policy and your agreement with DialClear.

In the event you initiate a chargeback or payment dispute, DialClear reserves the right to:

  • Immediately suspend or terminate your account and access to the Platform and all Services without notice and without refund;
  • Recover the disputed amount plus any related fees, costs, and expenses, including chargeback fees, processor fees, reasonable attorneys' fees, and collection costs, in accordance with applicable law;
  • Pursue any and all available legal remedies, including legal action for breach of contract, fraud, and recovery of damages; and
  • Submit this Refund Policy, the Terms of Service, and your acceptance thereof, together with your lookup history, as conclusive evidence in response to any chargeback or dispute.

If you have any billing concerns, you must first contact DialClear directly using the contact information below and attempt in good faith to resolve the matter with DialClear before pursuing any other remedy. DialClear will have at least thirty (30) days from receipt of your communication to investigate and respond to your billing concern before any chargeback or other action is initiated.

Future Business Relationships

In addition to the foregoing remedies, the filing of a chargeback or payment dispute in breach of this Refund Policy constitutes a material breach of your agreement with DialClear. DialClear reserves the right, in its sole discretion, to:

  • Permanently refuse to enter into any future commercial relationship with you, your business, or any entity you own or control;
  • Maintain an internal record of the breach for reference by DialClear and its affiliated companies; and
  • Share the circumstances of the breach with its affiliated companies, who may independently determine, in their own sole discretion, whether to provide service to you.

For purposes of this Policy, "affiliated companies" means any entity that, directly or indirectly, controls, is controlled by, or is under common control with DialClear LLC. The reference to affiliated companies in this Policy is for identification purposes only and does not create privity of contract with, alter the limited liability of, or grant third-party beneficiary status to any affiliated company, parent entity, or other related party. Your rights and remedies under this Policy are solely against DialClear LLC.

Account Closure and Outstanding Usage

You may stop using DialClear at any time — because there is no subscription, simply running no lookups incurs no charges. If you close your account or remove your payment method, any usage already incurred but not yet invoiced will still be billed on the next daily billing cycle, and you remain responsible for that final charge.

After account closure, you will no longer be able to log in, access your lookup history, or use the API or any integration. DialClear is under no obligation to retain, export, or otherwise make your data available to you after closure, and your data may be deleted in accordance with the Terms of Service and DialClear's data retention practices. It is your responsibility to export any lookup history or other information you wish to retain before closing your account.

State-Law Compliance

Where applicable state or federal law mandates a different refund right or chargeback procedure, that right or procedure will be honored to the minimum extent required by law.

DialClear will work with you in good faith to resolve any legitimate billing concern. Contacting DialClear first — rather than initiating a chargeback or payment dispute — is required under this Refund Policy and the Terms of Service.
